Terms of Service

1. Introduction

Welcome to opsappworks. These Terms of Service govern your use of our offerings for business software development of internal tools, portals, and automation ("Services"). By engaging our Services, you agree to these terms.

2. Service Scope

We design, build, and maintain custom software solutions tailored to your organizational needs. Services may include planning, development, deployment, and support.

3. Fees and Payment

All fees are quoted in the proposal and are payable as described in your project agreement. Payments must be made according to the schedule set forth in the agreement. Failure to pay on time may result in suspension of Services.

4. Delivery of Services

Project timelines and milestones are defined in the agreement. We will use commercially reasonable efforts to meet those dates, but we are not liable for delays caused by your changes, third-party issues, or force majeure events.

5. Refund Policy

5.1 Services

Service engagements are eligible for full or partial refund within 14 days of agreement signing if no substantive work has begun. To request a refund, contact our team via contact.html. Refunds will be issued via the original payment channel within seven business days. You may defer the scheduled Services to a later date by notifying us in advance.

5.2 Information Products

Digital products such as templates, guides, and training materials are eligible for refund within 7 days of purchase if less than 10% of the content has been accessed. No refunds will be granted if more than 10% has been accessed. To request a refund, contact our team via contact.html. Refunds will be issued within seven business days.

5.3 Goods

Physical items are eligible for refund within 30 days of delivery. Items must be sent back in original condition. To initiate a refund, contact our team via contact.html. Shipping costs are not refundable. Refunds for goods will be issued after inspection within ten business days.

5.4 Non-Refundable Services

Certain bespoke offerings such as customized workshops and on-site audits require dedicated preparation and consultant allocation. These services are non-refundable due to the unique resources committed. By purchasing such services, you acknowledge that all fees are final.

6. Modification of Services

You may request changes to project scope or timeline. Any change may affect fees and schedule. Scope modifications must be agreed in writing before implementation.

7. Limitation of Liability

To the fullest extent permitted by law, opsappworks will not be liable for any special, incidental, or consequential damages arising from the use or inability to use our Services, even if advised of the possibility of such damages. Our aggregate liability will not exceed the total fees paid for the applicable Services.

8. Termination

Either party may terminate a Service agreement if the other party materially breaches these Terms and fails to cure within 14 days after written notice. Upon termination, you will pay for all Services performed up to the termination date.

9. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in Dubai.
